The petitioner has approached this Court during the pendency of the proceedings before the learned Maharashtra Administrative Tribunal. As such we are not inclined to entertain the writ petition in the extra ordinary jurisdiction under Article 226 of the Constitution of India.

The learned counsel for the petitioner submits that the Division Bench of the learned Tribunal is not available and as such the matter cannot be finally decided.

Even if the Division Bench of the learned Tribunal is not available, the learned Member of the Tribunal sitting singly can very well consider the application for interim relief.

In that view of the matter, we dispose of the writ petition with a direction to the learned Member of the Tribunal to decide the application of the petitioner

for grant of interim relief as expeditiously as possible and in any case within a period of six weeks from today. JUDGE JUDGE halwai
