Heard the learned Counsel for the applicant and the learned A.P.P. for the State.

No specific role has been attributed to this applicant by any of the witnesses. The statements have been recorded under Section 161 of the Code of Criminal Procedure. This applicant has also not been identified, as no identification parade was ever held. Such position of the present applicant is quite similar with the case of Nikunj Meshram, who has been granted bail by this Court on 29/09/2016 in Criminal Application (BA) No.741/2016. Therefore, the applicant is also entitled to be released on the ground of parity. Hence, the order.

The application is allowed.

It is directed that the applicant be released on bail on his furnishing a P.R. Bond in the sum of Rs.20,000/- together

ba.793.16 2 with one solvent surety in the like sum on the conditions that (i) he shall regularly attend the trial Court on the dates fixed in the matter; (ii) shall co-operate with the trial Court in expeditious disposal of the case and (iii) shall not tamper with the prosecution witnesses in any manner.

The application is disposed of in above terms. Hamdast is granted.
