The first appeal is taken on against the judgment and decree passed in Special Civil Suit No.74/1998. The suit was preferred by the present applicant/appellant, wherein claim for recovery of damages and declaration is made. The contention was, respondent No.1/defendant No.1 has illegally detained the vehicle of the appellant.

02] Since the principal claim was against defendant No.1, against whom the appeal is already dismissed, the entire appeal proceedings abate. That being so, the proceedings are accordingly disposed of.
