Prayer is to condone the delay in filing first appeal. Reasons are mentioned in paragraphs 2 and 3 of the application. Application is opposed by the learned counsel for non applicant no.1 on the ground that no details are given regarding instructions received for filing the appeal. Considering the reasons assigned and accepting the same to be correct the delay in filing appeal is condoned subject to costs of Rs. 3000/-to be paid to non applicant no. 1 within three weeks from today.
