IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR WRIT PETITION NO. 7404/2019 (NIRUTA SAHADEO GEDAM & OTHERS VERSUS THE STATE OF MAHARASHTRA, THROUGH COLLECTOR, CHANDRAPUR & OTHERS) Office Notes, Office Memoranda of Coram, appearances, Court's orders of directions Court's or Judge's order and Registrar's orders.

Shri A.A. Dhawas, counsel for the petitioners. Shri A.S. Fulzele, Additional Government Pleader for the R-1 & 2. Shri S.V. Purohit, counsel for the R-3 & 4.

CORAM : A. S. CHANDURKAR AND URMILA JOSHI-PHALKE , JJ.

D ATE : SEPTEMBER , 202 2 .

The petitioners have approached this Court praying that the respondent nos.3 and 4-Maharashtra State Electricity Distribution Company Limited through its Chief Engineer be directed to provide electricity connection to them. It is their grievance that despite making several applications to the respondent nos.3 and 4 they have not been provided with electricity connection. Shri S.V. Purohit, learned counsel for the respondent nos.3 and 4 submits that if the requisite documents as required by the Maharashtra Electricity Regulatory Commission (Electricity Supply Code and Standards of Performance of Distribution Licensees including Power Quality) Regulations, 2020 and especially Regulation 5 thereof are supplied by the petitioners, the electricity connection would be supplied to them. He submits that though the petitioners have initially moved such applications, the documents required were not supplied.

In these facts, it is observed that it would be open for the petitioners to make an appropriate application seeking electricity connection by complying with the requirements of Regulation 5 of the Regulations of 2020. If such applications are made alongwith all requisite documents, the same shall be considered by the respondent nos.3 and 4 in accordance with such regulations. Needless to state that if the grievance of the petitioners still subsists after consideration of their respective applications, they are free to take legal recourse as permissible in law.
