Shri Dahat, learned counsel (appointed) for the applicant and Shri V.A. Thakare, learned APP for the respondent.

Criminal Appeal has been preferred by the prisoner (in jail) undergoing life imprisonment. The learned counsel appointed for him by Legal Aid Services Sub-Committee, Nagpur, points out that there is delay of 228 days in filing Appeal under Section 374(2) of the Code of Criminal Procedure. He is relying upon averments in the application.

The learned APP is seeking time to verify the facts.

However, as the applicant is in jail, we do not see any malafides. Hence, delay is condoned. The office to register Criminal Appeal.
