By this application, the appellants are seeking directions to issue No Objection Certificate for Renewal of the Passport.

The appellants have filed an appeal against conviction, bearing criminal appeal no. 447/2021, registered under Sections 143, 147, 341, 427 of the Indian Penal Code and Section 3(2)(A) of the Prevention of Damage to the Public Property Act, 1984. Appellant No.4 - Vaibhav Sudhirpant Khodaskar has recently applied for renewal of his passport vide an application dated 2/4/2025 through travel agency. The passport authority has already issued the letter and called the appellant No.4 for the purpose of renewal of the passport. However, the passport authority is asking for a No Objection Certificate from the concerned police station officer, and therefore, the rkn
960appp661.2025.odt appellant No.4 approached the concerned police station. The concerned police station officer has not issued the No Objection Certificate, as the appeal is pending before the court.

Considering the right of the present appellants to obtain a passport, the concerned police station officer shall issue a No Objection Certificate for renewal of their passports. The appellants shall seek permission from the District Court, Warud, before traveling abroad. It appears from the application that the sister of appellant No. 4 was married in 2023 and is currently residing in the USA, and appellant No. 4 wishes to visit his sister therefore, he has applied for renewal of his passport.

In view of the reasons mentioned in the application, the application is allowed.

The respondent is directed to issue no objection certificate. The appellants shall seek permission from this Court before travelling Abroad. [URMILA JOSHI-PHALKE, J.] rkn
