In this petition, the petitioners are seeking implementation of the Government Resolution dated 11th December, 1999 and particularly clause 11 which shows a Lecturer with Ph.D will be eligible for two advance increments as and when she/he acquires a Ph.D. degree in her/his service career.

According to the petitioners, despite the fact that the petitioners are entitled to receive two advance increments as per the said resolution, the same have been denied. It is further pointed out that the SKNair
968-wp-5718-23.odt representations were made to the Director of Higher Education since 2022 continuously. However, no decision has been taken on the same. 4.
Shri Patil, learned Assistant Government Pleader makes a statement that the respondent no.2 will decide the representation after considering the judgments passed in similar matters by this Court which are annexed along with the petition.

In that view of the matter, we are of the opinion that purpose will be served if the petition is disposed of with a direction to the respondent no.2 to decide the representations which are at page 133 and onwards at the earliest, considering the time period lapsed in between, and not in any case beyond two months from the communication of this order.

Accordingly, the writ petition is disposed of with a direction to the respondent no.2 to decide the representations of the petitioners referred hereinabove within two months from the date of communication of this order.

If the respondent no. 2 holds in favour of the petitioners, the monetary benefits which the petitioners would be entitled, shall be released at the earliest.
