Civil Application (CAO) No. 1263/2014 Prayer is to permit the respondent nos. 2 to 5 to withdraw the amount of compensation deposited by the appellant. It is stated that said respondents are facing hardship on account of death of their father in the accident.

fa213..15 The application is opposed by the learned counsel for the appellant on the ground that higher amount of compensation has been granted.

Considering the findings recorded by the Claims Tribunal, respondent nos. 2 to 5 are permitted to withdraw 50% of the amount deposited by the appellant subject to furnishing undertaking that in case the appeal is allowed, said amount shall be repaid with interest at such rate the Court may direct.

The civil application is disposed of.
