DATE : 08/09/2022 1] The application seeks transfer of Petition No. A/154/2021 from the file of Family Court, Yavatmal, to that of the Family Court, Nagpur.

2] It is an admitted position that the applicant resides at Nagpur and there are proceedings under the D.V.Act pending at Nagpur, considering which Mr. Thenge, learned counsel for the non-applicant has no objection for the transfer, in view of which Petition No. A/154/2021 is transferred from the file of Family Court, Yavatmal to that of the Family Court No.4 Nagpur, where Petition No. A-1565/19 is already pending.

3] An oral request is also made that the D.V.

proceeding bearing Cri. M.A. No.4213/19 pending on the file of 20th Jt. CJSD, Nagpur having special powers under the DV Act also be transferred to the Family Court No.4 Nagpur, so that the all the proceedings can be decided

(2) 13mca648.21 together, relying upon Sanket Sanjeev Khanolkar vrs. Surabhi Sanket Khanolkar, 2021 (5) ALL MR 306. 4] The request is accepted and the Cri. M.A/ 4213/2019 pending on the file of 20th Jt. CJSD, Nagpur having special powers under the DV Act is also transferred to the file of Family Court No.4 Nagpur. 5] The parties shall appear before the Family Court No.4 Nagpur on 19.9.2022 and place a copy of this order to apprise it of the same and so also the respondent shall place a copy of this order before the Family Court, Yavatmal on 12.9.2022 to apprise it of the present order. 6] Application is accordingly disposed of in the above terms. No. costs.
