Since the remedy of raising challenge to the order of promotion dated 17/08/2023 issued to the respondent No.3 is available under Rule 14 of the Maharashtra Zilla Parishads District Services (Discipline and Appeal) Rules, 1964 before the Divisional Commissioner, liberty is granted to the petitioner to challenge the same before the said Authority.

One of the grounds as raised by the petitioner is incorrect preparation of seniority list. Needless to state that since the order of promotion is granted on the basis of said seniority list, it would be open for the petitioner to challenge in the said appeal, the preparation of seniority list.

Hence, keeping all points raised in the writ petition open and with liberty to the petitioner to avail statutory remedy as available, the writ petition is disposed of.
