Seen affidavit sworn by the learned counsel. As we do not see any malafides, the order dated 07.08.2017 is recalled and Writ Petition No. 5168 of 2017 is restored back to file.

WRIT PETITION NO. 5168 OF 2017 The corrected index of list of annexures supplied by the learned counsel for the petitioners is taken on record. 2.

Heard. The submission is, after report of Enquiry Officer was found perverse, in present case, the matter should have been sent back for inquiry and final relief could not have been granted. The submission is, the entries in documents with customers and with the department did not match.
