CIVIL APPLN. (O) NO.1753 OF 2015 The applicants cannot be necessary parties to Writ Petition No.5073 of 2015, decided on 16/09/2015. If the applicants were aggrieved by the order of the Commissioner of State Excise, dated 29/06/2015 that was sought to be implemented by the original petitioner in Writ Petition No.5673 of 2015, the applicants could have filed appropriate proceedings for challenging the said order. However, the applicants are not necessary parties to Writ Petition No.5073 of 2015 in which the original petitioner had sought a direction to the Collector to implement the order of the Commissioner of State Excise that was not stayed by the State Government or any other Court or authority.
In view of the aforesaid, the civil application stands rejected.
