The Petitioner-informant has filed this petition seeking expeditious disposal of Regular Criminal Case No.4147/2016 pending on the file of Judicial Magistrate First Class, Nagpur. It is primely contended that though the case is filed in the year 2016, for last 6 years there is no progress as the trial Court has even not framed charges. 3.

The learned A.P.P. has brought to our notice that the accused have applied for discharge Rgd.

Order 0903wp712.22 to the Trial Court, which was rejected. Being aggrieved, the accused has filed Criminal Application No.1407/2022, in which this Court vide order dated 18.10.2022 directed the trial Court not to frame charges against applicants therein. It is submitted that this Court has dismissed the aforesaid Criminal Application on 02.03.2023, and the matter is fixed for framing charge before the trial Court on 28.03.2023.

The learned A.P.P. submitted that both accused did not cooperate in the trial Court that is why the matter was adjourned from time to time. In view of above, the trial Court shall expedite the proceedings and if the accused are not cooperating, the trial Court is free to take all coercive methods to secure presence of accused as permissible in law.

In view of above, Criminal Writ Petition is disposed of.
