Heard Shri P.A.Gode, learned advocate for the applicants-appellants. None appears for the respondents. The appeal is admitted on 3rd October, 2012 and interim stay has also been granted.

Considering the facts on record, I am satisfied that the execution of the decree is required to be stayed till decision of the appeal, however, on the condition that the appellants shall not create any third party right or interest in the suit property and shall not change the nature of the property without seeking prior permission of this Court. The appellants shall deposit Rs.One Thousand with the High Court Legal Services Sub-Committee, Nagpur and produce the receipt on the record till 14th December, 2015, as the prayer in the civil application is not in consonance with the provisions of Order 41 Rule 5 of the Code of Civil Procedure.

The Civil Application is disposed in the above terms.
