The application under Section 24 of the Code of Civil Procedure for transfer of Marriage Petition No.28/2024 from Wardha to Yavatmal.

The applicant and the respondent are husband and wife. Due to the strained relationship between them, the applicant - wife has filed the petition under the Protection from the Domestic Violence Act bearing No. PWDV/66/2023 which is pending before the learned Judicial Magistrate First Class, Yavatmal and the Marriage Petition for dissolution of marriage was filed by the respondent bearing No.28/2024 before the Joint Civil Judge Senior Division, Wardha. During the pendency, this transfer petition was placed before the Lok-Adalat on 30.11.2024. Before the Panel, both parties have agreed to transfer the marriage petition from Joint

(2) 64.mca.763.2024 Civil Judge Senior Division, Wardha to Family Court, Yavatmal.

In view of the fact that both parties have agreed to transfer the marriage petition from Wardha to Yavatmal, the application deserves to be allowed. Accordingly, I proceed to pass following order:

ORDER

(i) The application is allowed.

(ii) The Marriage Petition No.28/2024 pending before the Joint Civil Judge Senior Division, Wardha is withdrawn and transfer to the Family Court, Yavatmal.

(iii) Both parties shall appear before the Family Court, Yavatmal as well as Judicial Magistrate First Class, Yavatmal, on 23.01.2025.
