Heard the learned Counsel for the appellant. None for the respondents.
However, the learned Counsel for the appellant has invited my attention to the joint pursis singed by the appellant and all the claimants, who are the respondent Nos.1 & 2 in the present appeal, stating that the matter has been amicably settled between the appellant and respondent Nos.1 & 2 in terms of the conditions as well as the amount mentioned in the pursis, dated 12/11/2016.
Perusal of this compromise pursis thus indicates that the parties have settled their dispute amicably and they have also spelt out in details the terms and conditions of their amicable settlement. The joint compromise pursis is, therefore, accepted.
Accordingly, the appeal is partly allowed in terms of the joint compromise pursis, which shall form part of the decree. The parties to abide by the terms and conditions of the joint compromise pursis dated 12/11/2016 marked as "X" for identification. Parties to bear their own costs throughout. The appeal is disposed of in these terms.
