Learned counsel for the petitioner on instructions seeks leave to withdraw the present writ petition with liberty to file an appeal against the impugned order dated 5th August, 2024. If such appeal is filed within a period of three weeks from today, the same shall be treated as filed within the period of limitation. The trial Court shall defer the hearing of suit in question for the period of three weeks.

The writ petition is disposed of as withdrawn with liberty as sought.
