It is seen from the order dated 9.7.2025 that the appellant failed to deposit the deficit court fees since the year 2017 i.e. the date on which the appeals were filed before this court. Therefore, this court was constrained to dismiss the appeal for not depositing the deficit court fees. 2.

The learned counsel for the appellant-applicant states that the applicant is a poor agriculturist and not having the independent earning source and, therefore, there was a delay on his part to comply the office objection in the matter. However, he made a solemn statement that within a period four weeks he will deposit the court fees if the present appeal is restored on its original position.

In view of this statement of the applicant, the order dated 9.7.2025 is recalled to the extent of First Appeal No.175/2017.

The office is directed to restore the present appeal on its original position by recalling the order dated 9.7.2025.
