The petitioner has approached this Court challenging the order dated 6th September, 2016 passed by the respondent no.1Returning Officer, rejecting the objection raised by the present petitioner regarding inclusion of respondent nos. 2 to 5 in the voters list.

Perusal of the election programme, which is annexed at Annexure "A" would reveal that the process of the election has reached a substantial stage. The date of declaration of the valid nomination was 15th September, 2016.

In that view of the matter, we are not inclined to entertain the petition, at such an advanced stage of the election programme.

We, however, make it clear that we have not adverted to the merits of the petition and the petitioner would be free to raise the grounds raised in the petition in appropriate proceedings, as permissible in law.
