The petitioner has basically prayed for staying effect, operation and any action by the Nagpur Municipal Corporation on the plot mentioned in the petition and construction on it. The respondent N.M.C. has sought action against the petitioner on the ground that the construction made by the petitioner is unauthorized.

We do not find that a case is made out for invoking extraordinary jurisdiction under Article 226 of the Constitution of India. The petition is, therefore, rejected relegating the petitioner to the remedy available to him in law.
