The learned Additional Public Prosecutor in our view is right that the rejection of the furlough leave by the respondent - Authority is in consonance with law inasmuch as the petitioner is convicted for the offence punishable under Section 376 of the Indian Penal Code. 3.

In that view of the matter, the criminal writ petition is disposed of.

Mrs. Shilpa Giratkar, learned counsel appointed by the High Court Legal Services SubCommittee, Nagpur to represent the petitioner will be entitled to professional fees quantified as Rs.2500/-
