Heard Shri M.B. Agasti, learned counsel for the petitioner and Shri M.M. Ekre, learned AGP for respondent Nos. 1 & 2.

The petitioner - an employee of Respondent No. 3 - Municipal Corporation seeks direction to Respondent No. 2 - Committee to expedite verification of caste claim. Shri Ekre, learned AGP is seeking time as he has still not received instructions.

Nobody appears for respondent No. 3, though served.

This Court has issued notice in the matter on 04.12.2015 and protected the employment of the petitioner. Shri Agasti, learned counsel submits that on the basis of that order, the petitioner even today continues to be in service.

In this situation, without prejudice to rival contentions, we direct Respondent No. 2 to expeditiously decide the caste claim of the petitioner, if it is not decided as yet.

2504wp6171.15 We direct the petitioner to appear before Respondent No. 2 for the said purpose on 07.06.2016 and to abide by its further instructions in the matter. The Committee shall attempt to complete verification in accordance with The Maharashtra Scheduled Castes, Scheduled Tribes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance & Verification of) Caste Certificates Act, 2000 (Maharashtra Act No. 23 of 2001), within next one year.

Interim orders dated 04.12.2015 passed by this Court shall continue to operate till then and shall be subject to the decision of Respondent No. 2 - Committee. Writ Petition is thus partly allowed and disposed of. No order as to costs.
