This application is filed by applicant wife for transfer of Hindu Marriage Petition No.199/2017, which is filed by respondent husband for grant of divorce before Civil Judge, Senior Division, Buldhana, to the Court of Civil Judge, Senior Division, Pusad, District Yavatmal contending that having been deserted by respondent, applicant is constrained to stay in her parents' house at village Mahagaon, District Yavatmal and it is not possible for applicant to go to Buldhana to attend proceedings in Hindu Marriage Petition No.199/2017. It is submitted that as there are no conveyance facilities from Mahagaon village to Buldhana and since she has also a child, she would face hardship

0811mca977.17 2/2 to attend the Court at Buldhana. It is, therefore, prayed that above petition be transferred to Court at Pusad. Respondent having been served with notice of this application, chose to send reply by registered post contending that if he is required to attend the Court at Nagpur in this application, he apprehends threat to his life and has given no objection for transfer of his petition from the Court at Buldhana to Court at Pusad as prayed by applicant.

In that view of the matter, miscellaneous civil application is allowed. Hindu Marriage Petition No.199/2017 pending in the Court of Civil Judge, Senior Division, Buldhana stands transferred to the Court of Civil Judge, Senior Division, Pusad, District Yavatmal. Parties to appear before the Court of Civil Judge, Senior Division, Pusad, District Yavatmal on 4/12/2017.
