Applicant/respondent No.1 has filed this application for permitting him to withdraw the amount of compensation deposited by the appellant, for which learned counsel for the appellant has objected.

Having considered the reasons disclosed in the application as well as gone through the impugned judgment and order, I do not find substance in the objection raised by learned counsel for appellant. In view of the above, in my opinion, the applicant is entitled to withdraw 75% compensation amount along with interest accrued thereon on his furnishing the usual undertaking to the satisfaction of the Registry. Accordingly, the application is partly allowed and disposed of.

Registrar (J) is directed to transmit the 75% compensation amount along with interest accrued thereon, within six weeks, on his furnishing the usual undertaking and the bank account details to the registry.
