SECOND APPEAL NO. 01/2012 CORAM : REGISTRAR (JUDICIAL) DATED : 06/10/2022 The office has been putting up this matter on the Registrar (Judicial) Board since 21.10.2021. The matter was last listed before Hon'ble Court on 29th September, 2021, as it was pandemic period and as adverse orders were not being passed by the undersigned, the matter was so placed before the Hon'ble Court. The Hon'ble Court after observing that the appeal stands automatically abated, adjourned the matter as the appellants wanted to take steps for bringing LR's on record and the matter was adjourned for three weeks. It appears that for the first default the matter was placed by put up note dated 20.10.2021. Thereafter, matter was listed on Registrar (Judicial) Board on 21.10.2021, 09.12.2021, 06.01.2022, 09.06.2022 and lastly today.

Despite several chances, no steps are taken to bring the LR's on record whose names are also provided in the Pursis St. no. 8842/2019. It appears that the appellant is not interested in prosecuting the second appeal. Though, the respondent has expired on 22.04.2015. In terms of Chapter VII Rule 6(2) the second appeal stands abated.
