In so far as non-applicant No.1 is concerned, though she expired during pendency of of the reference proceedings, her legal heirs are already on record. Hence name of the non-applicant No.1 is permitted to be deleted.

Perused the contents of the Civil Application. As the applicant was not a party in the reference proceedings it is granted leave to file the appeal. Civil Application is allowed in terms of prayer clause (i). ..2/-
