DATED : SEPTEMBER 13, 2019 Heard Mr. Wankhade, learned counsel for applicant and Mr. Thakare, learned A.P.P. for non applicantState. Also perused the reply. Applicant is arrested in connection with Crime No.137/2019, registered with Police Station, Karanja Lad City, Tq. Dist. Washim, for an offence punishable under Sections 363, 376, and 506 of the Indian Penal Code. The investigation is over and charge-sheet is also filed. According to prosecution, victim is a major girl. Her report would show that there was acquaintance with the first informant and the present applicant. Reply would show that applicant took the victim to Shegaon from Karanja, stayed in a lodge and committed sexual intercourse. Thereafter, victim was taken to Dadar by train. From Dadar, she was taken to Pune by bus. Thereafter, applicant brought victim at Badner.

Since, charge-sheet is already filed, in my view, further custodial presence of applicant is not necessary.

ORDER

(i) The application is allowed.

(ii) Applicant-Pravin Parasram Naik be released on bail in connection with Crime No.137/2019, registered with Police Station, Karanja Lad City, for an offence punishable under Sections 363, 376 and 506 of the Indian Penal Code, on he executing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in like amount.

(iii) Applicant is directed not to enter territorial limit of Karanja Lad where victim resides, till culmination of trial. (iv) Applicant shall furnish his residential address before the Court below at the time of execution of the bail bonds. On furnishing such address, Court below shall issue directions directing the applicant to attend the nearest police station, once in a month till culmination trial. (v) Applicant shall not tamper with prosecution evidence.

The application is disposed of.
