This is an application for putting evidence on record pertaining to educational expenses of two children who are in the custody of applicant. Indisputably, these documents or application do not form part and parcel of the trial Court's record nor any evidence was recorded pertaining thereto.

Mr. Bhandarkar, learned counsel for the applicant-wife submits that since he has a remedy to approach the trial Court under Section 127 of the Cr.P.C., he would not like to press the said application. Mr. Gaikwad, learned counsel for non applicant has no objection for allowing withdrawal of this application.

In view of above, Criminal Application No.1137/2015 is dismissed as withdrawn with liberty as stated in this order.
