DATED : 06/06/ Respondent No.1- Wasudeo s/o Maroti Gajbhiye expired and the appellants got knowledge orally from learned Advocate representing respondent No.1. The details of the legal representatives are given in paragraph No.2 of the application. It is submitted that learned Advocate Shri N.B. Ramteke has appeared earlier for all the respondents including respondent No.1. Intimation was not given to the Court about death of respondent No.1. Notice was issued to proposed legal representatives and they have not appeared in spite of service.

In view of that application is allowed. Name of respondent No.1 be deleted. Names of proposed legal representatives be added. Amendment to be carried out within seven days and then notice be issued on the appeal.

The matter be kept after four weeks.
