SEPTEMBER 15, 2017 Heard Mr. C.A. Joshi, Advocate for applicant and Mr. V. Gangane, A.P.P. for the non applicant-State. The applicant, since was apprehending arrest in connection with Crime No.274/2017, registered with Police Station, Borgaon Manju for an offence punishable under sections 354, 452 of the Indian Penal Code read with Section 3 (1) (w) (i) (ii) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, he has approached this Court by preferring the present application. This Court had on 29.08.2017 issued notices to the non applicant and granted ad interim protection in favour of the applicant with a condition that the applicant shall attend Police Station, Borgaon Manju on 02.09.2017, 03.09.2017 and 06.09.2017 and shall be with the investigating officer from 2.00 to 5.00 p.m. and shall extend full cooperation to the investigating officer. The learned counsel for the applicant submits that the applicant had attended the Police Station. This particular submission about the attendance is not
aba619.17.odt controverted by the learned A.P.P. Rather, in a positive way, the learned A.P.P. submits that the applicant has attended the Police Station and he was also interrogated. According to the prosecution case, on the day of incident, the applicant who is a doctor while he was examining his patient, had entered into the house of the first informant and by asking for a glass of water, he tried to catch hold of her hand.
Looking to this nature of allegation against present applicant and the fact that applicant has already attended the Police Station for good three days and he has already been interrogated, following order is passed.
ORDER
(i) Criminal Application No.619/2017 is allowed.
(ii) The applicant-Sanjay Bhanudas Mondhe, in the event of arrest in connection with Crime No.274/2017, registered with Police Station, Borgaon Manju for an offence punishable under sections 354, 452 of the Indian Penal Code read with Section 3 (1) (w) (i) (ii) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, be released on bail on he executing PR Bond in the sum of Rs.25,000/-with one solvent surety in the like amount.
The application stands disposed of.
