Class-II occupancy land was sold by applicants 1 to 5 to applicant no. 6. Applicant no. 6 came to know that Class II occupancy land could not have been sold. Therefore, he filed a police complaint basically under Section 420 of Indian Penal Code. In the process, he also attempted to point out commission of offence under Sections 468 and 471 of Indian Penal Code. It is not in dispute that the parties have amicably settled the controversy. The sale-deed has been cancelled by a
1512apl714.15 registered document and the sale consideration paid by applicant no.6 (complainant) has been paid back to him by applicants 1 to 5. In this situation, the compromise entered into between the parties is accepted. Accordingly, we allow the amendment pointing out that subsequently charge-sheet has also been filed. Charge-sheet No.110/15 and Crime No. 140/13 at Police Station Barshitakli, District akola, is quashed and set aside. Application for amendment is allowed.
Memo in Criminal Application be amended suitably within three days.
