31st October, 2017 Shri J. Y. Ghurde, learned Addl. Public Prosecutor, accepts notice on behalf of the non-applicant. By this application, it is prayed that Criminal Application No. 2697 of 2007 which was dismissed in default be restored. In the application, it is stated in para 4 that the report of the hearing party cases was not uploaded on the date when the application came to be dismissed.

The application is opposed by the learned APP on the ground that the applicants are not diligent and

hence the proceedings do not deserve to be restored. Considering the reasons mentioned in the application, the order dated 21st August, 2017 is recalled. The proceedings are restored to file. Application is allowed and disposed of.
