DATE : 29/09/2025 1) The applicant is arrested in Crime No.177 of 2025, registered with Police Station Old Kamptee district Nagpur for the offence punishable under Section 109(1) of the Bharatiya Nyaya Sanhita,2023.
2) On 17.04.2025 the victim and his friends went to tea shop in Ismailpura to have a tea. The accused/applicant abused the informant and his friends and thereafter left from the spot. On 18.04.2025, at around 12.30 p.m. the victim and his friends went to Goyal Talkies Chowk to enquire with the applicant. The applicant stabbed the victim on the back with knife, with intention to kill him. The victim was

On the statement of victim recorded in the hospital, the crime is registered. 3) The learned counsel appearing for the applicant has stated that earlier the complainant has assaulted this applicant. Counter FIR is registered. The statement of the one of the witness is recorded in this First Information Report, he has stated about the assault on applicant by the victim and other three persons. Considering the FIR and as the applicant is discharged prayed to release the applicant on bail.
4) Learned Government Pleader, has stated that the counter FIR is there. CCTV footage shows that he stabbed brutally on the back of the injured. The trial can be expedited. Hence, prayed to reject the application. 5) Heard both the sides.
6) There is counter FIR in this case. The statement of the one of the witness shows that earlier the injured in this crime has assaulted the applicant with other three persons. Considering the counter FIR, there is no need to keep the applicant in custody during the trial.
7) Accordingly, I pass the following order:

ii) Applicant- Sheikh Uzaif Sheikh Maqsood be released on bail in Crime No. Crime No.177 of 2025, registered with Police Station Old Kamptee district Nagpur for the offence punishable under Section 109(1) of the Bharatiya Nyaya Sanhita, 2023 on his furnishing P.R. Bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one surety in the like amount.
iii] The applicant shall not in any way tamper with the prosecution evidence.
iv] The applicant shall not pressurize or threaten the prosecution witnesses.
v] The applicant shall co-operate the investigation officer.
vi] The applicant to attend the trial court regularly.
8) The Criminal Application stands disposed of accordingly.
