The present application has been filed under Section 29-A of the Arbitration and Conciliation Act, 1996 seeking
cao1657.1658.1656 & 1655.2019.19 extension of time to complete the arbitration proceedings. In the application it is stated that in terms of order dated 26.09.2016 the necessary compliance of depositing the amount of security was complied with by both parties. A request had been made to the learned Arbitrator to commence the proceedings. The notice in that regard was issued only on 03.08.2019. It is therefore prayed that the time to complete the proceedings be extended. Reply has been filed on behalf of the non-applicant no.1 stating therein that sufficient steps had not been taken by the applicant to ensure initiation and completion of the arbitration proceedings. The reasons mentioned in the application are not sufficient.
After perusing the application as well as the reply thereto and on hearing the parties, it is seem that the initial compliance that was required to be done by the parties has been done within the stipulated period. The applicants are senior citizens and it is their case that they had requested the learned Arbitrator to commence the proceedings. Accepting aforesaid ground the time to pass the award in terms of initial order dated 26.09.2016 is extended by period of six months from today. The learned Arbitrator shall take all efforts to pass award within the aforesaid period and no further extension would be granted. Civil Applications are allowed and disposed of. JUDGE Sarkate
