Heard.

The applicant has apprehension of arrest in Crime No.560/2025 registered at Police Station Arni, District Yavatmal for the offences punishable under Sections 7, 7A, 12 of the Prevention of Corruption Act, 1988.

The Sarpanch of village Gram Panchayat, Kuraha (Talani) has passed the resolution for effecting the beautification and development of the cremation ground in the village and for that purpose, the expenses, quotation of Rs.10,00,000/- was proposed and on 03.04.2025, the said work was sanctioned by the Gram Panchayat, Yavatmal. The said work was completed on 07.07.2025. The Branch Engineer made the spot inspection and he was supposed to issue the inspection report and the completion certificate to Gram Panchayat for the billing purpose. Thereafter, the informant visited the officer of Sub-Engineer, P.W.D., Zilla Parishad, Yavatmal for clearance of the bill related to the said work. At that time, accused Santosh Kshirsagar demanded amount of Rs.20,000/- to clear the entire bill amount of Rs.10,00,000/- as a bribe. The

2 5.aba.597.25 Verification Panchanama was conducted. During the trap, the driver of said Santosh Kshirsagar was found in possession of the said amount.

The learned Counsel for the applicant has stated that the applicant was not present there. He has not demanded any amount. In pre-trap also, he was not there. Said Santosh Kshirsagar as mentioned in the offence is made as accused. The applicant is retired person. He is not a Government Servant and hence, prayed to confirm the anticipatory bail granted to this applicant. 5.

The learned A.P.P. has stated that the applicant is attending Police Station as per condition. The applicant is not a Government Servant. The allegations are made that he is the middle person between the complainant and the said accused No.1 Santosh Kshirsagar.

Considering the role played by this applicant and as he is a retired person, the anticipatory bail granted to the applicant is confirmed on the same terms and conditions contained in the order granting interim protection.
