The applicant is apprehending his arrest in connection with Crime No.204/2017, registered with Police Station, Armori, Dist. Gadchiroli for an offence punishable under Sections 65 (E) and 83 of the Maharashtra Prohibition Act.
Looking to the nature of accusation that the applicant was not present at the time of raid and the entire contraband were already seized by the investigating officer, this Court had on 04.09.2017, granted ad interim protection in favour of the applicant on a condition that the applicant shall attend Police Station, Armori on 07.09.2017 and 08.09.2017 between 11.00 a.m. to 5.00 p.m.
Mr. Thawkar, learned counsel for the applicant submits that as per the directions of this Court,
aba622.17.odt the applicant had attended the investigating officer and was with him on the aforesaid dates and time. This statement is not controverted by the learned A.P.P. On the contrary, she submits that the investigation is already complete and interrogation of the present applicant has already been done.
In that view of the matter, the application is allowed. Ad interim bail granted to the applicant on 04.09.2017 is confirmed.
The application stands disposed of accordingly.
