The present application is filed for restoration of Writ Petition No. 184/2024. The said writ petition was dismissed in default on 29/07/2025 on the ground that the Petitioner did not turn up in spite of direction to appraise the Court about status of his pensionary benefits. The reason given for non appearance is the no objection was granted by earlier Counsel, however, Vakalatnama remained to be filed in the Petition and, therefore, the Counsel engaged subsequently was absent.

The learned Counsel for the Respondent vehemently opposed the Application on the ground that there is no reason to restore the writ petition.

Considering the reasons, the application needs to be allowed subject to costs of Rs.2000/- as no due diligence is shown. Accordingly, we pass the following order : (i) The Application is allowed subject to costs of Rs.2,000/- (Rs. Two Thousand only). The costs to be paid to the Respondents within a period of two weeks. (ii) The Registry is directed to restore the Writ Petition on its original number after payment of costs.

The Miscellaneous Civil Application stands disposed of.
