This application under Section 482 of the Code of Criminal Procedure is preferred seeking quashment of the First Information Report Number 49 of 2017 and the chargesheet dated 12.3.2017 filed by Police Station, Sakkardara against the applicants for offence punishable under Section 498A read with Section 34 of the Indian Penal Code.

It is submitted that the matrimonial dispute is amicably settled. The complainant - Shweta Wasnik who is personally present confirms that the dispute is amicably resolved and she further states that she has no objection if the proceedings are quashed. 3.

We see no impediment in quashing the proceedings and allowing this application in terms of prayer clause 1, which reads thus:- "Pass any appropriate order and thereby Quash the FIR no.49/2017 dated 3.2.2017 so also the charge sheet bearing no.40/2017 dated 12.3.2017 .....2/-

apl1364.22 8 filed by the Police Station Sakkardara against the applicant no.1 to 3 for offence punishable under section 498A R/w section 34 of IPC so also the consequent criminal proceedings bearing RCC no.874/2017 (ANNEXURE I), pending in the court of Hon'ble Judicial Magistrate First Class Corporation Court No.1 Nagpur in the interest of justice."

However, the order of quashing the proceedings shall come into effect only when the applicants collectively deposits Rs.20,000/- and the non-applicant 2 deposits Rs.20,000/- with the Registry of this Court within the next two weeks. If the costs is deposited, the Registry shall remit the same in the account of the Police Welfare Fund, Nagpur. If the costs is not deposited, let the application be listed under the caption "for directions".
