This is an application for condonation of delay in setting aside abatment of appeal against respondent No.6. Delay of three years and nine months is caused to bring the legal heirs of the respondent No.6 on record. 2.

Learned Advocate for respondent Nos.3 and 6(B)&(C) strongly objected the said application. 3.

Heard learned Advocates for both sides.

Perused the application. Considering the reasons stated in the application, the application is allowed in the interest of justice. Delay is condoned subject to deposit costs of Rs.1,000/- (Rs. One Thousand only), to be paid to the Vidarbha Ladies Bar Association, Nagpur within a period of two weeks.
