After hearing learned counsel for the applicant for some time and on expressing that the Court is not inclined to grant regular bail, in view of the observations made in the order of the trial Court that the applicant is not co-operating to proceed with the trial and therefore, even the charge could not be framed, the learned counsel for the applicant on instructions undertakes to co-operate with the learned trial Court for framing of charge.

He further seeks permission to withdraw the present application with liberty to move a fresh application before the trial Court, in case there will be no progress in trial in near future.

Permission to withdraw the present application is granted with liberty to move a fresh application after six months, if charge is not framed even after co-operation of the applicant as he has undertaken.

Criminal application is disposed of as withdrawn.
