DATE : September 13, 2017 By this application it is prayed that the second appeal be disposed of in view of the fact that the parties have arrived at a compromise amongst themselves. The appellants are the original defendants in a suit for partition filed by respondent No.1. In the application it is stated that the respective parties have relinquished their shares in favour of the other parties and on that basis necessary documents have been executed. It is further stated that the parties have been put in possession of their respective shares. The application is signed by all the parties. The parties are also present in Court today and are identified by their learned counsel.
In view of aforesaid, the second appeal is disposed of in terms of compromise dated 28/08/2017. The
901-CAS-946-17 2/2 judgment of the appellate Court in R.C.A. 19/2012 dated 15/11/2014 is modified in terms of the compromise and decree be drawn in terms of the compromise.
The second appeal is disposed of in aforesaid terms with no order as to costs.
