Thait, learned Counsel holding for Mr. Abhay Sambre that the applicant did not submit any request for appointment of arbitrator and that the present application is, therefore, not maintainable inasmuch as the prerequisite procedure as would entitle this Court to appoint the arbitrator is not complete, the learned Counsel for the applicant states, without prejudice, that in order to avoid any technical objection, the applicant may be permitted to withdraw this application with liberty to take recourse to the provisions of the Arbitration and Conciliation Act, 1996.
