By this application, the applicant, who are the original claimants seeking condonation of 113 days delay in filing the appeal.

It is stated by the applicant that due to death of bread earner of the family, they were facing financial crisis, and therefore, could not file the appeal immediately after the judgment of the Tribunal. 4.

Learned Counsel for the respondents strongly opposed the application stating that no sufficient reasons stated in the application to condone the delay. 4.

However, looking to the averment made in the application which according to me are sufficient to condone the delay, hence, application is allowed. Delay stands condoned.

Office is directed to restore the appeal and list the same as per its turn.
