DATE : 16/06/2022 1] The appellant/State seeks leave to appeal against the judgment dated 15.6.2020, whereby the respondent has been acquitted of the offence under Sections s 353, 323, 504 of IPC (pg 18). It is contended that the finding of acquittal rendered based upon the observations in para 13 of the judgment in question, was not justified, considering which a case for leave is made out.

2] Leave to appeal is granted. Office to register the appeal.

3] Considering that the matter involves the short point, it would be desirable to decide the appeal at the stage of admission itself, if the R&P is received.

4] Issue notice to the respondent, returnable on

5] Mr. Sirpurkar, learned counsel waives service of notice for respondent on merits.

6] It is informed that R&P has already been received, considering which both learned counsels submits that the matter can be heard and finally decided on 15.7.2022. 7] List the matter for final hearing on 15.7.2022 at the end of the admission board.
