Heard Mr. S. S. Sitani, Advocate for applicant and Mr. V. Gangane, A.P.P. for non applicant-State. The applicant is arrested in connection with Crime No.806/2017 registered with Police Station, Rajura, Dist. Chandrapur for an offence punishable under Section 394 and 427 of the Indian Penal Code.

Though the incident had occurred on 28.07.2017 and at the spot itself police were also present, the FIR is lodged on 31.07.2017 by the complainant, Imran. According to the FIR, it is not attributed that the present applicant has taken away the amount of Rs.1,80,000/- from the car. According to the learned A.P.P., the role that is attributed against the present applicant is that he was present and he broke the windscreen of the car.

According to the learned A.P.P., the stick which was used by the learned counsel for the applicant is also recovered.

ba835.17 In that view of the matter, following order is passed.

ORDER

(i) Criminal Application No.835/2017 is allowed.

(ii) Applicant-Kasim Yunus Sheikh, be released on bail in connection with Crime No.806/2017 registered with Police Station, Rajura, Dist. Chandrapur for an offence punishable under Sections 394 and 427 of the Indian Penal Code, on he executing P.R. Bond in the sum of Rs.25,000/- with two solvent sureties in the like amount.

(iii) The applicant shall attend Police Station, Rajura, Dist. Chandrapur once in a week i.e. on every Saturday between 3.00 p.m. to 5.00 p.m. till the chargesheet is filed. The application stands disposed of.
