Admittedly, caste claim of petitioner is still pending. The learned Assistant Government Pleader informs that it is transferred very recently to respondent no.1 from other Scrutiny Committee. This Court has on 9/10/2015 while issuing notice for final disposal protected employment of petitioner.

In this situation, we direct petitioner to appear before respondent no.1 Scrutiny Committee on 23/5/2016 and to abide by its further instructions in the matter. The Scrutiny Committee shall attempt

0305wp5664.15 2/2 to complete exercise of caste verification within next one year in accordance with The Maharashtra Scheduled Castes, Scheduled Tribes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification Of) Caste Certificate Act, 2000 (Act No. XXIII of 2001). Till then service of petitioner shall remain unaffected, however, its continuation shall be subject to such adjudication.

The writ petition is thus partly allowed and disposed of. No costs.
