The grievance of the petitioner is that in terms of the order dated 16th August, 2017 passed in Contempt Petition No. 252 of 2014, the Social Welfare Officer had not taken any decision on his pension case.
As per the notice issued in the contempt petition, the respondent has been served. Shri Godeshwar learned Assistant Government Pleader on behalf of the said respondent on instructions submits that a decision has been taken on 1st March, 2019 by the Assistant Commissioner of Social Welfare, whereby the petitioner has been held not entitled to receive pensionary benefits. Communication dated
cp-239-18 1st March, 2019 is taken on record and marked as document "A" for identification, a copy of which has been addressed to the petitioner.
In view thereof as decision has been taken by the said respondent, nothing survives in this Contempt Petition. If the petitioner is aggrieved by the order dated 1st March, 2019, he is free to take steps as permissible in law.
The Contempt Petition is accordingly disposed of.
