We have perused the impugned order passed by the respondentCommittee whereby the caste claim of the petitioner as that of belonging to "Kunbi OBC" is rejected.

Admittedly, neither the Police Vigilance Cell report is served on the petitioner nor the same is dealt with in the impugned order. Even otherwise, the respondent-Committee does not give proper reasons for rejection the claim of the petitioner. As such the order impugned not only is contrary to the statutory provisions of law but also suffers from non-application of mind. 3.

As such, the petition is allowed by quashing the impugned order dated 23rd May, 2018 thereby directing the respondent-Committee to serve copy of the Vigilance Cell report to the petitioner on 3rd April, 2024, the date on which the petitioner undertakes to appear before the Committee. 4.

The petition stands disposed of accordingly.
