By this contempt petition, the petitioner has sought action against the respondents for willful disobedience of the judgment passed by this Court on 22.09.2015 in Writ Petition No.2945 of 2001 as also the direction issued by the Deputy Director of Education, dated 21.06.2016. It appears that by our order dated 07.04.2016, we had only directed the Deputy Director of Education, Nagpur to decide the pension case of the petitioner and also as to what quantum of salary/back wages are payable to the petitioner. In pursuance of our order, the Deputy director of Education has decided the matter. The order of the Deputy Director of Education is challenged by the management in a writ petition in this Court, that is pending. We do not find that any direction issued by this Court in the judgment dated 22.09.2015 is disobeyed. By the said decision, we had only directed the Deputy Director of Education to decide the issue pertaining to the grant of pension, salary/back wages and the awarding of interest on
CP352-16 delayed payment of pensionery benefits. Our order stand complied with, as the Deputy Director of Education has decided the issues. If the Deputy Director of Education has passed an order in favour of the petitioner and if the same is not complied with, the petitioner has other remedies. In any case, since the respondent has challenged the order of the Deputy Director of Education and since our judgment stands fully complied with, the contempt petition cannot be entertained.
The contempt petition is, therefore, dismissed with no order as to costs.
